Ever wonder why many of Donald Trump’s appointees are ‘acting?’
By making the appointment temporary, the Senate does not convene to approve or deny the candidate. That means the Senate does not advise and consent to the nomination. Advise and consent was built into the Constitution in order to assure that the Executive Branch was not flooded with incompetent appointees, like it is at this very moment.
Congress needs to enact a low which limits the time during which an appointee can assume and office before being forced to appeal to Congress for consent.
